The complainant alleged that in a programme aired by the channel a shameful event of Agra railway track was telecasted. In the programme, a man with injured feet was shown with a train passing over him. He alleged that the channel’s reporter or camera person who recorded the footage did not try to save his life.

NBSA noted that in view of the denial by the broadcaster and stating that the camera person who recorded the footage of the man being crushed under a train was not their employee but a stringer and since there was no further communication after the broadcaster had sent him a response, NBSA did not consider it fit to proceed further with the matter. The matter be closed.

S.NO 692. Channel INDIA TV Complainant Mr. S.P. Singh, Returning Officer, Bulandshehar Date of Broadcast 14.2.2012 Complaint

The Returning Officer desired to know why action should not be taken against the channel for airing a live telecast on their channel during the UP election campaign. It was stated that in the permission given to the broadcaster, it was clarified that there would be no speeches, slogans etc. which would hurt the sentiments/feelings of any religion, caste or community. However, they received complaints that the programme aired by the channel was contrary to the permission and they had violated the Model Code of Conduct of EC.

NBSA decided that in view of the competent constitutional authority, namely the Election Commission of India, already being seized of the matter, it would not be appropriate for NBSA to pursue the matter any further. Accordingly the matter was closed.

S.NO 693. Channel Surya TV (Non- Member) Complainant Rt. Rev. Dr. Euyakim Mar Coorilos [MoI&B] Date of Broadcast 21.10.2011 & 22.10.2011 Complaint

Since Surya TV was not a member of NBA, the matter had been referred to the MIB vide letter dated 24.1.2012, requesting the MIB to write to the channel to cooperate with NBA/NBSA in disposing the complaint.

NBSA noted that as has been decided action in respect of complaints of non-members would only be taken up after a communication was received from the MIB on how it proposes to proceed in respect of complaints of non-members.

S.NO 694. Channel NTV (Non- Member) Complainant Ms. K. Shanti Vardhan, Secretary, Navatejam, on behalf of Members of Navatejam (State level Network for MSM and TG) [MoI&B] Date of Broadcast 31.10.2011 & 1.11.2012 Complaint

Since NTV was not a member of NBA, the matter had been referred to MIB vide letter dated 31.1.2012, was requested to write to the channel to cooperate with NBA/NBSA in disposing the complaint.

NBSA noted that as has been decided action in respect of complaints of non-members would only be taken up after a communication was received from the MIB on how it proposes to proceed in respect of complaints of non-members.

S.NO 695. Channel CNBC and Zee Business Complainant Ms. Jyoti Shankar Sindhaw [MoI&B] Date of Broadcast Complaint

MIB had forwarded a complaint dated 7.6.2011, which was more than six months old. The complaint was rather vague with no specific details of broadcasts. The essence of the complaint was that corporate/financial news was telecasted without verification resulting in loss to the viewers who rely on the information aired by the business channels.

NBSA noted that the essence of the complaint related to insufficient verification before airing corporate/financial news, which issue the NBSA was already seized off .To ensure balance in reporting corporate/business issues Guidelines are being drawn up which would be circulated soon to all Editors and Members of NBA for compliance. The complaint was closed.

S.NO 696. Channel NA Complainant Mr. Onkar Singh, Advocate [MoI&B] Date of Broadcast Complaint

MIB forwarded a copy of legal notice dated 10.10.2011 regarding naming of Indian cricket team as “Team India” and using of derogatory language. It is alleged that during the news broadcast, live commentary, discussions, Indian cricket team was termed as ‘Team India’ and whenever Indian team lost any match there were bold captions like “Team India ki Sharamnak Haar” “Team India Mooh ke bal Giri” “Team India ka Bura Hall” etc. which was illegal, misleading, derogatory, defamatory, highly objectionable, disrespectful and insulting language was used in the programmes.

NBSA also decided that no further action was required to be taken in the matter as the complaint was delayed. However, on the larger question of language used while reporting news/programmes relating to cricket or other sporting events, NBSA noted that this was part of the training module proposed by the NBSA to sensitize editorial personnel in improving broadcasting standards. The complaint was closed.

S.NO 697. Channel NTV (Non- Member) Complainant Tupperware IndiaPvt. Ltd. [MoI&B] Date of Broadcast 22.9.2011 Complaint

MIB forwarded a complaint in which it was alleged that a programme was telecast on the channel which showed that Tupperware was a pyramidal network which duped housewives into buying their products or enrolling in their business opportunity. The story also claimed facts about Tupperware India (like Tupperware India does not pay any sales tax (VAT) etc.), which had no premise. The complainant alleged that the story had damaged the image of the company and the brand.

Since the broadcaster is not a member of NBA, NBSA therefore decided that a communication be sent to the Minister for Information & Broadcasting drawing her attention to the lacunae in handling complaints of non members and also to furnish to them the details of cases where no response had been received from non-member broadcasters. Only on receipt of a communication from MIB, would the complaint be considered. The complaint was filed.

S.NO 698. Channel TV9 Gujarat Complainant Mr. Saiyed Makbul Husain Anvarali Date of Broadcast 29.7.2011 & 30.7.2011 Complaint

Since the complainant did not receive a response, he had approached NBSA by filing a formal complaint. The complainant had alleged that without any evidence or proof of involvement in anti-national activities, the broadcaster aired false news regarding his links with Pakistan. The police have not found any evidence to establish his link with terrorist organizations or terrorist activities.

NBSA decided that in view of the settlement arrived at between the parties (as evidenced by a communication sent by the Advocate representing the complainant) no further action needs to be taken and the complaint be closed.

S.NO 699. Channel Star News Complainant Dr. Shobha Vijender Date of Broadcast 23.12.2011 Complaint

The complainant alleged that the broadcaster had telecast a report which stated that congress was alleging that Sampurna NGO was given grant-inaid due to Shri. Vijender Gupta, who happens to be the husband of the complainant. She alleged that the channel had shown lopsided story and demanded the channel to provide her the complete and unedited recording of her interview both recorded on camera and telephone by the channel’s correspondent as well as the program aired by them on.

NBSA noted that the complainant in her response to the broadcaster’s reply had stated that the broadcaster chose to report on a matter which was sub judice. NBSA noted that since the matter was subjudice, NBSA could not proceed under its regulations. The complainant was informed accordingly and the matter be closed.

S.NO 700. Channel INDIA TV Complainant Mr. M.J. Khan Date of Broadcast 26.1.2012 Complaint

The complainant alleged that the channel in its special programme ‘Operation MLA’ had shown Mr. Saleem Ansari, Peace Party MLA from Shamli caught in camera for all the wrong reasons. The complainant stated that the party had declared Mr. Anwar Chowdhary as its candidate from Shamli three weeks back which had appeared in all the newspapers all over the state. The complainant alleged that the channel had deliberately under conspiracy targeted and maligned Peace Party and caused immense loss of reputation and image during the peak of election time. They demanded compensation of Rs.10 crore and apology to be run on their channel of equal duration and prominence.

NBSA decided that no further action needs to be taken in the matter as the Election Commission of India had taken cognizance of the contents of this sting operation and had called for the transcript. NBSA further noted that after considering the transcript, the decision taken by the Election Commission had been circulated vide Press Note dated 28.1.12. NBSA decided that in view of the competent constitutional authority, namely the Election Commission of India, already being seized of the matter, it would not be appropriate for NBSA to pursue the matter any further. The decision of NBSA had been conveyed to the complainant and the broadcaster. The complaint was closed.
