The complainant stated that the telecast on India TV and by two non member news channels i.e India News Network and Sahara Samachar made his life miserable and did irreversible damage to him & to the prestige and reputation of his family. He stated that one Ms.Uma Sharma had made false allegations against him, which were aired by the aforesaid channels without verifying the details and despite the matter being sub-judice. The news item related to alleged rape and extortion of money by Mr. Kamal Kishore. The complainant also forwarded to NBA & India TV & others, the scanned copy of the judgment dated 2.8.10. , which stated “that the prosecution has miserably failed to prove its case against the accused beyond the shadow of any reasonable doubt, who is thus hereby acquitted of the offence he stands charged with……”

NBSA considered the complaint only in relation to India TV, member NBA and the response .NBSA noted that India TV had provided a platform to the complainant to put his point of view, which was aired on the channel NBSA noted the amicable settlement between the broadcaster and the complainant and also the order passed by a Sessions Judge, Gurgaon discharging the complainant in the criminal proceedings. NBSA decided to close the matter.

S.NO 892. Channel ETV2 Telugu Complainant Dr. N. Pullaiah Date of Broadcast 27-07-2010 Complaint

The complaint was by the Director, Makhteshim-Agan India Pvt. Ltd., Hyderabad. who alleged that ETV 2 was scrolling news on the channel that Makhteshim Agan India was manufacturing and distributing spurious material and requested the channel to stop the telecast immediately as it was damaging the reputation and image of the Company.

NBSA considered the complaint and the response. NBSA after deliberating on the issue, decided that the original script of the news aired on ETV2 Telugu with English translation may be sought from the broadcaster, which they submitted and the NBSA was of the view that an opportunity should have been given to the complainant. The complaint was closed.

The complaint was regarding continuous reportage of the marriage of Mr. M.S. Dhoni by all private news channels. He alleged that all news channels were giving importance to a matter which is of no national concern, while the important national matters were totally ignored.

The complainant had requested the channel to provide the news source relating to telecast of news item “Jagdish Tytler is being removed as in-charge Bihar”.

S.NO 895. Channel Times Now Complainant Legal Notice dated 21.5.2010 from Mr J. G. Desai, Advocate on behalf of client Mr. Mohanbhai Sanjibhai Delkar. Date of Broadcast 20-04-2010 Complaint

The Legal Notice stated that Times Now had telecast a wrong news/story that a senior Maoist leader was freed from police custody by a violent mob led by Congress MP in Silvassa , Daman. It was stated that the news was totally false and baseless. His client had never led any such mob. The defamatory news had severely damaged his clients reputation and image amongst the general public as well as the Congress party. Therefore an unconditional apology was demanded from the channel .

NBSA decided that since the legal notice clearly indicated the complainant’s intention to initiate legal proceedings, the NBSA deemed it inappropriate to proceed further with the matter. NBSA observed that the complainant was free to resort to legal remedy available to him in accordance with law. The complaint was closed.

NBSA at its meeting held on 17.5.2010 decided to take suo motu action to ascertain whether the members followed the Code of Ethics & Guidelines while reporting the Pratapgarh stampede,which resulted in loss of several lives

S.NO 897. Channel All Member Channels of NBA Complainant Suo motu action by NBSA Date of Broadcast Complaint

NBSA understood from Editor Members of NBSA that the genesis for issuing the Advisory dated 24.2.2010 by MoI&B was because some broadcasters had carried the interview of Mr Hafiz Sayed, the wanted terrorist based in Pakistan. NBSA noted that if the broadcasters had carried the interview, it was a violation of the guidelines .To ascertain the violation, NBSA decided to take suo motu action by instructing all broadcasters to submit unedited tapes of the interview and also decided to issue show cause notices to this effect to all the broadcasters .It was decided to issue show cause notices to this effect to all the broadcasters.

The complainant lodged a complaint before the NBSA regarding an episode “Ankho Ke Lutere” which was telecast on TV9 news channel, when it was not a member of NBA.

NBSA noted that since the regulations did not permit NBSA to take up complaints of a non- member, it would not be in a position to take cognizance of the complaint. The complainant was informed .accordingly and the matter was disposed off.

S.NO 899. Channel Star News Complainant Sant Rampal Dass Date of Broadcast 7.3.2010 Complaint

The complaint pertained to a telecast of a news story which stated that cosmetics, highly sophisticated weapons, tunnels and hydraulic chairs were found in the Sant Rampal Dass Satlok Ashram Karontha, Distt. Rohtak (Haryana). It was also stated that Sant Rampal Dass was using all these items to enjoy and to befool the people by creating an aura of divinity around him. The complainant alleged that all the allegations were false and the weapons allegedly found in the Ashram were licensed and belonged to individuals.
Since there was no response to the complaint, the broadcaster was served with a legal notice, to which they responded. It was stated that they deny all the allegations and the telecast was done in good faith and for public good, without any intention to malign or defame anyone.

S.NO 900. Channel IBN7, Zee News, ETV UP/Uttaranchal Complainant Mrs. SD Bajaj [3 complaints] Date of Broadcast 20.12.2009 Complaint

A common complaint was made against the channels regarding airing of a news report which related to a matrimonial dispute concerning the complainant’s son, which was pending in the Supreme Court and a Family Court in Mumbai. In the complaint she alleged that the channels had carried only the version of the opposite side which resulted in a biased reporting by the concerned channels.
