ETV received a legal notice from the lawyer of the complainant regarding a news report telecast on, on ETV (UP) regarding the speech given by the MLA in the Kurmi Maha Sammelan held at Sohawal Tehsil, Faizabad on 20.4.10. It was alleged by the complainant that the telecast was tampered, which was denied by the broadcaster as the reporter and camera person of ETV were present at the Sammelan. The broadcaster stated that similar reports were carried in other news channels.

NBSA considered the complaint and the response and decided that since there was no further communication from the complainant, the complained be closed.

S.NO 902. Channel Aaj Tak Complainant Mr. Zulfikar Ali Pathan & family Date of Broadcast 13-04-2010 Complaint

The complaint pertains to telecast of a news story which stated that his recently widowed mother was physically tortured, abused and harassed by him to sign certain property documents.The complainant alleged that all the allegations in the report were false and untrue and one sided. .

NBSA considered the complaint and the response from the broadcaster, which stated that the telecast has been based on an FIR filed and corroborated by his sister. NBSA decided that since there was no further communication from the complainant, the matter may be treated as closed. NBSA while closing the complaints was of the considered view that personal matters which impinges on the privacy of individuals must only be aired if the reporting of such matters is in “public interest” and not otherwise. News channels should not give any individual(s)/ party (ies) an opportunity to use the news channels as a platform to air incidents/views on personal/ family matters. It would be advisable that Editors to speak to each other and take a collective view before airing such stories.

S.NO 903. Channel INDIA TV Complainant Mr. Ashish Srivasatva, Director Chemtron Science Laboratory, Mumbai Date of Broadcast 31-03-2010 Complaint

The complaint was regarding incorrect reporting of the product used for artificial ripening of bananas. He alleged that it was wrongly shown that “acytelene gas” was a product of Chemtron Science Laboratory, Mumbai which is a harmful substance used for ripening bananas. The complainant alleged that “ethylene” gas was the product of their laboratory that is used to ripen banana and it was not harmful.

NBSA considered the complaint, response from the broadcaster, which stated that they aired a complete show giving all the information regarding banana ripening, which cleared all the mistakes and also carried the interview of the complainant. NBSA decided that since the complaint had been sorted out to the satisfaction of the complainant, the complaint be closed.

S.NO 904. Channel NDTV India Complainant Mr. Dinesh V. Sharma Date of Broadcast 03-05-2010 Complaint

The complaint related to the content of the programme “Khabardar” carried on NDTV India, which related to the sentencing of Ajmal Kasab and acquittal of two other persons, whose innocence was overemphasized and Malegaon blast was used to cover up to hush their acquittal rather than demonstrating what went wrong with the police administration in court and what led to arrests etc. .

The NBSA noted that the broadcaster had received a complaint relating to the content of the programme “Khabardar” carried on NDTV India on 3.5.10 and since the complaint was received on 4th May, 2010 they were in the process of responding to the same.

S.NO 905. Channel Aajtak & Live India Complainant Mrs. Mahima Agarwal, Mr. Rajan Agarwal [2 complaints] Date of Broadcast 16-06-2009, 19-06-2009 Complaint

The complaint was in respect of an alleged blood extraction case from minors in Hindaun, Rajasthan involving Dr. Girish Agarwal and Dr. H.N.Singh. The news clippings had labeled both doctors as Dracula who were involved in taking blood of little children. It was claimed that doctors were involved in a blood trading racket and blood extracted from minors were sold at very high price. The complainant alleged that the news items had made number of severe allegations on the doctors which were not mentioned even by police in their final investigation report and such news reports had created negative picture of them.

NBSA decided that since the subject matter is sub judice, the NBSA would not be able to take cognizance of the complaint. The matter has been disposed off. 8.3.2010: NBSA noted that the complainants on receipt of the decision took the view that the subject matter of the present complaint against the broadcasters was not pending before any Court of Law and NBSA was requested to take cognizance of the complaint. NBSA re-considered the decision and decided that since the subject matter was sub judice, NBSA would not be able to take cognizance of the same.

S.NO 906. Channel INDIA TV Complainant Mr. Radheshyam Sharma Date of Broadcast Complaint

The complainant alleged that continuous misinformation was being transmitted against Asharamji which has resulted in violence against the sadhaks. The complainant desired to know if he could file a complaint as there was delay beyond 7 days.

NBSA considered the complaint and the reply given by the broadcaster and decided that while it could condone the delay of making a complaint within the period of 7 days of the first telecast, but in the absence of any specific particulars and details of the programme/specific broadcast telecast by India TV with date/time etc & with supporting documents, it was not possible to proceed further in the matter.
NBSA decided that the complainant may be informed accordingly and a copy of the guidelines may also be sent to the complainant so that they are aware of the procedures to be followed for redressal of complaints. With these observations the complaint was closed .

S.NO 907. Channel Aaj Tak Complainant Mr. Radheyshyam Sharma Date of Broadcast Complaint

The complainant alleged that the channel had misreported the issue regarding Asharamji in order to defame him without checking facts.

NBSA considered the complaint the response of the broadcaster, which stated that channel had always appropriately included version of Asharam or its spokespersons. NBSA decided to close the matter.

S.NO 908. Channel News X Complainant Col .A.S Chauhan, Director, Media , Army HQ, New Delhi Date of Broadcast 02-12-2009, 03-12-2009 Complaint

The complaint pertained to a news item regarding the alleged incident at Indore in which the complainant alleged that the name of the Commandment, The Infantry School, Mhow being mentioned was totally baseless and malicious with an intent to defame the army. The complainant stated that since the matter was sub judice in a criminal court in Indore , it would not be appropriate to comment upon the factual details of the alleged incident .The complainant alleged that the report regarding the issue of arrest warrant against any officer of the Army by any court of Indore was totally false and concocted.

NBSA considered the complaint & the response given by the broadcaster and decided that the broadcaster may be advised to forward a tape, which contains the broadcast of the incident that took place in Indore which was aired on the channel on 2nd & 3rd December 2009.

S.NO 909. Channel News X Complainant Dr V. Ravi Chandran Date of Broadcast 02-12-2009 Complaint

The complainant alleged that the broadcaster had showed a document purported to be the “evidence” that the complainant had abused his son Aditya Chandran. He stated that the channel should have investigated more carefully before disparaging his good name on national TV. Complainant stated that the “evidence” was an old report and various courts had decided later that the child abuse allegations are false and baseless, and have authorized the custody of Aditya to the complainant.

NBSA considered the complaint, response from the broadcaster .NBSA noted that in view of the action taken by the broadcaster of airing the interview of the complainant several times on 6th & 7th January 2010, the matter may be treated as closed.

S.NO 910. Channel Aaj Tak Complainant Ms. Gagan Kaur Date of Broadcast 6.10.2009 Complaint

The complaint is that while covering the rally of Smt. Sonia Gandhi in Nanded, Maharashtra, at the end of the news, the news was concluded with the following words “Sava Lakh se ekh laraoo, Tabhey Gobind Singh Naam Kahooo”. According to the complainant misused the Sikh religion’s holy hymns.

NBSA considered the complainant, response of the broadcaster and noted that since the broadcaster had clarified that the use of the quote was not meant or intended in any manner to denigrate the Sikh religion, NBSA accepted the explanation and closed the matter.
